Criminal offences, modern style

A bunch of convicted criminals who were caused 'pain and suffering' when they were forced to come off drugs in jail are to receive compensation because their human rights have been infringed.
A bunch of tax payers working for West Lancashire District Council are to have their smoking breaks removed and to be banned from smoking anywhere on council property or in council owned cars. Do they have any human rights?
